Fact Check: Did the Supreme Court Declare Waqf Properties Illegal? Here’s the Truth

A screenshot of a cropped news article by Live Law, a legal news portal, has gone viral on social media. The screenshot can be read as: “Ownership of immovable property does not get transferred unless the sale is registered: Supreme Court. Historic judgment of Supreme Court today with this one sentence. The entire property illegally claimed by the Waqf Board and others has been invalid now.” (English Translation).

Fact Check

During the investigation, DFRAC found the claim to be false. We found a original and full story, published on January 8, 2025, on ‘Live Law,’ which states: “The Supreme Court has reiterated that the ownership of an immovable property does not get transferred until the sale deed is registered. Mere transfer of possession and payment of consideration will not transfer ownership unless the sale deed is registered. Referring to Section 54 of the Transfer of Property Act, 1882, a bench comprising Justice BV Nagarathna and Justice NK Singh observed.” Throughout the article, there has been no mention of the Waqf Board.

It is evident from DFRAC’s fact check that the viral screenshot of Live Law has been shared falsely, since there is no mention of the Waqf Board or any Waqf property in the original article.
