A claim is getting viral on social media sites that all the convicts in the Nirbhaya case were sentenced to death, but the one who caused the most hooliganism, Mohammed Afroz was released due to being a minor.
Sewa Bharat News shared a picture of Delhi Chief Minister Arvind Kejriwal on Facebook and posted,” Everyone was hanged but one culprit survived, #Mohammed Afroz to whom Arvind Kejriwal gave a ‘sewing machine’ and Rs 10k. The person who raped Nirbhaya in such a dirty way how he can be a minor? Because Mohammad Afroz is AAP leader, MLA Muslim Waqf Board’s Delhi chairman Amatullah Khan’s, uncle’s son, Kejriwal saved the team of lawyers of the Muslim Waqf Board By making a false medical certificate.” (English Translation)

Fact check:
To analyze the viral claim, the team of DFRAC searched with the help of some Keywords on google. The team found many reports published by different media houses in this regard.
According to a report of BBC Hindi, there were a total of 6 convicts in the Nirbhaya case.
Bus driver Ram Singh and his younger brother, Mukesh Singh. His family came to Delhi from Rajasthan 20 years ago. His house was in Ravidas Jhuggi Jhopri Colony of South Delhi. Moreover, those who were held guilty by the court were Vinay Sharma, Akshay Thakur, Pawan Gupta, and a minor.
Regarding this, Ram Singh committed suicide in jail while serving his sentence and the minor was sent to a juvenile home for three years. This is the highest punishment given to any minor under Indian law. Disclosure of his name and address is forbidden by law and thus has been kept secret as there is a legal bar on the declaration.
One India quoted the Hindustan Times in its report, “An officer involved in the rehabilitation process of the minor said that he was always afraid of being killed. So, he was shifted somewhere in South India. He currently earns his living by working in a well-known restaurant. The person who hired him has also not been told about the past of juveniles. The official says that under the aftercare program, we cannot make his identity public. It’s our job to protect it.”
Conclusion:
It is clear from the fact check of DFRAC that in the Nirbhaya case, irrespective of whether the minor was Hindu or Muslim, his name and address have been kept a secret under the law, and no one knows who he is. Even if someone gets to know him and reveals his name and address, it will be a crime, so the claim of social media users is fake and misleading.
